LES CONSEQUENCES DU BREXIT EN MATIERE D’IMMIGRATION

Le 29 mars 2017, le Royaume-Uni a décidé de quitter définitivement l’Union Européenne. L’accord sur « le Retrait du Royaume-Uni, de la Grande Bretagne et de l’Irlande du Nord de l’Union Européenne et de la Communauté de l’énergie atomique » (Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community) a été conclu le 31 janvier 2020.

En matière d’immigration, deux situations des ressortissants britanniques devront être distinguées :

1.Les ressortissants Britanniques entrant en France à partir du 1er janvier 2021

Les ressortissants britanniques et leurs familles entrant en France à compter du 1er janvier 2021 seront soumises aux dispositions d’entrée et de séjour des étrangers de droit commun et devront demander leur titre de séjour à la préfecture de leur domicile en France. Ils seront soumis au Code d’Entrée et de Séjour des Etrangers et du Droit d’Asile (CESEDA).

2. Les ressortissants britanniques vivant en France avant et après le BREXIT

En application de l’accord du 31 janvier 2020, les ressortissants britanniques et les membres de leur famille qui résidaient en France avant le 31 décembre 2020 conservent leurs droits acquis en tant que citoyens européens.

Mais ils sont tenus de demander la délivrance de titres de séjours spécifiques portant la mention « Accord de retrait du Royaume-Uni de l’UE ».

Cette demande de titre doit être effectuée avant le 1er juillet 2021 et les ressortissants britanniques et leurs familles devront détenir le titre de séjour mentionné à compter du 1er octobre 2021.

On March, 27th, 2020, the United Kingdom decided to withdraw from the European Union. The Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community – Citizens’ Rights was concluded on January 31st, 2020.

With regards to Immigration issues, two situations shall be distinguished:

1. British citizens entering into France from January, 1st, 2021

British citizens and their families entering into France from January 1st, 2021 shall be submitted to the French Entry and Residence of Foreign Citizens and Asile Law (CESEDA). British citizens shall apply for a Residence Permit as any foreigner not citizen of the EU.

2. British citizens living in France before and after the BREXIT  

British citizens residing in France before January 31st, 2021, and staying in France after this date, shall apply for the Residence Permit with the mention “Agreement on the withdrawal of the United Kingdom from the EU”.

British Citizens and their families shall apply in order to get the Residence permit before July, 1st, 2021. They shall detain the residence permit with this specific mention before October, 1st, 2021.
